1. A SUMMARY OF THE CONTRACT
The photographer is responsible for providing for the client a photographic service and products as detailed in section 2 (‘coverage’). The client undertakes to engage the photographer for this coverage for the price as detailed in section 3.

Coverage begins at the agreed time and is limited to a maximum 12 hours attendance. Attended time may also include breaks; travel too, from and between the venues. Additional hours are by agreement at time of booking and at the sole discretion of Forever Photo Studio. Charges of £100 an hour will apply outside the stated coverage times.

A £100 booking fee to secure the date and payable on execution of this agreement. This booking fee is non-refundable or transferable in the event of cancellation, it being the agreed loss suffered by the photographer due to cancellation.
Balance to be paid after booking fee, no later than one month before the date of the wedding.

The Client may cancel this contract any time after it has been signed by sending written notice to The Photographer. If the written notification is received more than 120 days before the date the wedding is due to take place then The Photographer will reimburse The Client any monies paid, except for the Booking Fee. If the written notice of cancellation is received within 120 days of the due wedding date then the amount of the price that The Photographer shall be entitled to is calculated in accordance with the table below.
0-30 days = 100%, 31-60 days = 75%, 61-90 days = 50%, 90-120 days = 25%, 121+ days = 0% The cancellation conditions above will apply for postponed weddings if the photographer is not able to re-schedule for the new date and time. The fee for postponed weddings is subject to change. Any additional payments for albums and other services are to be made when that order is placed. Prices for orders placed over one year after the date of the wedding may be subject to change. This includes orders that are part of the initial wedding package e.g. the bride and groom’s album.
4. CREATIVE LICENCE
The Photographer shall be granted creative and artistic license in relation to the choice of locations and poses used. Judgement on photographic style and the number of photographs taken and delivered shall be deemed correct. On its own behalf, and on behalf of the subject, The Client acknowledges that they are familiar with The Photographer’s portfolio and are requesting services with knowledge of The Photographer’s style; that The Photographer’s work is constantly evolving; that The Photographer’s services are of unique and artistic nature; that the photos may be different from photographs taken by The Photographer in the past; and that in creating the photos, The Photographer shall use his personal artistic judgment to create images consistent with his personal vision of the event, which vision may be different from The Client’s and the subject’s vision of the event. Accordingly, The Client acknowledges that the photographs shall not be subject to rejection on the basis of taste or aesthetic criteria. The Photographer will endeavour to take all the photographs agreed. However, because a wedding is an uncontrolled event, the photographer cannot guarantee delivery of any specifically requested image(s), especially if timings or events are altered without our knowledge. Due to changes of the weather and the availability and willingness of subjects The Photographer will do their best to honour requested photographs but cannot undertake to guarantee any specific picture nor incorporate any specific background, location or group arrangement. During a wedding The Photographer will automatically re-take any photograph where they have seen that someone has blinked, but it is impossible to guarantee to see them all. The more people in the photograph the more difficult it is to see everyone. The Photographer will provide a pleasing colour balance but cannot guarantee exact colour matching. Owing to anomalous reflectance caused by a combination of certain dyes and materials, especially manmade fibres, it is sometimes impossible to record on film/digital media the exact colour of materials as seen by the human eye. Any additional editing and/or retouching will be subject to an hourly rate of £75 per hour. Retouching includes but is not limited to additional skin softening/smoothing, correction of hair/makeup/clothing, swapping a face from one image to another, environmental effects, reflections in glasses, teeth whitening, brightening of eyes, and bodily enhancements.
5. EXCLUSIVITY
The Photographer shall be the sole professional (still) photographer at the venues specified. We do however positively encourage family, friends, and other guests to take photographs throughout the day.
6. HOUSE RULES
The Photographer is sometimes limited by rules imposed by registrars, ministers and venue management as to what can and cannot be done. For example some ministers insist that no flash photography is allowed, and others will insist that The Photographer shoot from a specific location. In such circumstances the bride and groom agree to accept the technical limitations that may be imposed on the equipment used. We advise the bride and groom to make themselves aware of the rules of the venue concerned and if necessary negotiate with the people concerned.
7. VIEWING AND ALTERATIONS
Final images are to be supplied in a 10-12 week period following the wedding ceremony. The Client will be able to view these photos in their own online gallery at www.foreverphoto.studio. If requested as part of the wedding package a final selection of photos will be chosen and The Photographer will design these into a Photobook and produce a PDF file for final proofing by The Client. A maximum of three edits will be included. Any extra edits will be charged at the hourly rate of £75 per hour. Once the design has been agreed it will be sent to the Photobook manufacturers for completion. No further editing can take place after this time.
8. DELIVERY
Once a set of high resolution digital files have been delivered, the responsibility to preserve the images passes to The Client, and the decision whether The Photographer will keep a copy or not will be entirely at The Photographer’s discretion.
9. THIRD PARTY PRINTING
The Photographer cannot accept any responsibility or liability for colour balance or quality of any Prints reproduced from the USB Memory Stick that we supply by Third Party Printers such as High Street photo processing shops.
10. COPYRIGHT
The copyright Designs and Patents Acts assign the copyright of the images to The Photographer. Any images or copies of images whether stored digitally or otherwise and any computer program including any source or object code, computer files or printed documentation relating to such images are protected by the Copyright and Design Act 1988. It is contrary to the Act to copy or allow to be copied photographically/electronically or by any other means an image created as part of this contract without the permission of The Photographer/s in writing. A licence of your wedding photos is given to The Client upon full payment under the following conditions. The digital images taken by The Photographer are for personal use by The Client and their friends and relatives. The Photographer will provide The Client with a print licence as proof of this permission. Sale, Publication or any Commercial use of the photographs is not allowed without prior written permission from The Photographer.
11. MODEL RELEASE
The Client hereby grants The Photographer the irrevocable and unrestricted right to use and publish photographs of the client or in which the client may be included for editorial, trade, advertising or any other purpose and in any manner and/or medium considered standard by the wedding industry. Such mediums/purposes include, but are not limited to: advertising, internet promotion, photographic contests, public displays, photography books, wedding blogs, studio display, sample wedding albums, and any other use thought proper by The Photographer and considered standard by the wedding industry.
12. ATTENDANCE
In the unlikely event of the photographer is unable to complete the coverage due to unforeseen circumstances, the photographer reserves the right to appoint another photographer to attend on his behalf to undertake the photography.
13. INDEMNITY
The Photographer agrees to indemnify The Client against all expenses, damages, claims and legal costs arising out of any failure by the photographer to obtain any clearances for which he was responsible in respect of third party copyright works, trademarks, designs or other intellectual property. The Photographer shall only be responsible for obtaining such clearances if this has been expressly agreed before the day of the wedding. In all other cases The Client shall be responsible for obtaining such clearances and will indemnify the photographer against all expenses, damages, claims and legal costs arising out of any failure to obtain such clearances.
14. LIMITATION OF LIABILITY
In the unlikely event of a total photographic failure or cancellation of this contract by either party or in any other circumstances, the liability of one party to the other shall be limited to the total value of the contract. Neither party shall be liable for indirect or consequential loss. The undersigned have read and understood the above contract and agree to the terms and conditions in their entirety.
15. PERSONAL ACCIDENT
Any directions issued to clients, their guests or employees during a photographic shoot are deemed to be at said persons own risk. The photographer cannot be held responsible for any personal accidents during a photographic shoot.
16. COMPLAINTS PROCEDURE
Any complaints should be made within 4 weeks of the images being supplied in writing to Forever Photo Studio, 6 Aspen Close, Timperley, WA15 7YF. We will endeavour to respond to any complaint within 48 hours. In the event of any dispute regarding this contract, both parties agree to attempt to obtain a conciliation before taking any other action.
17. PRIVACY
Forever Photo Studio will store your details on a private internal database. These details will not be made available to companies or individuals outside of Forever Photo Studio.
